Saudi Arabia's new salary clause and what it means for you

The new amendments make life easier for employees

The Ministry of Justice and the Ministry of Human Resources and Social Development have just announced the launch of the new Saudi salary clause. The new clause will then act as an enforceable document.

The new Saudi salary clause will be added to a notarised employment contract and aims to document workers’ rights and obligations to prevent injustices and reduce the volume of disputes in courts. It will come into circulation by way of the technological link between the Qiwa and Najiz platforms.

The new Saudi wage clause will act as a legal document that allows the employee to submit a request for enforcement if their salary hasn’t been released, without any additional documents. Verification is then automatically completed through the link with the Madad platform.

To benefit, all contracts must be registered on the Qiwa platform, and an implementation number needs to be obtained from the Ministry of Justice’s documentation centre.

According to the new clause, if an employee doesn’t receive their full salary within 30 days of the due date, or if they receive it partially after 90 days, they can submit an electronic implementation request through the Najiz platform. The employer then reserves the right to object within five days of the notification date.

The two ministries also announced the launch of the unified employment contract. This contract aims to prevent injustices for all parties by documenting the employment contract, establishing its rights and obligations, and officially acknowledging it as an enforceable document, particularly when it comes to salaries.
